Welcome to EyeOnKid ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our monitoring services, website, and applications (collectively, the "Service"). EyeOnKid provides parental and employee monitoring solutions, allowing users to track activities on Android, iOS, Windows, and macOS devices. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Acceptance of Terms

By creating an account, installing the EyeOnKid app, or accessing our dashboard, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. You also agree to comply with all applicable laws and regulations regarding the use of monitoring software.

3. User Responsibilities

As a user of EyeOnKid, you agree to:

  • Use the Service only for lawful purposes, such as monitoring your own children under 18 or employees on company-owned devices with proper consent.
  • Obtain explicit consent from any adult you intend to monitor, where required by law.
  • Not use the Service to collect, store, or transmit any illegal content or engage in illegal activities.
  • Ensure that your use of the Service complies with all local, state, national, and international laws, including privacy and data protection laws.
  • Be solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

EyeOnKid is not responsible for any misuse of the Service that violates applicable laws or these Terms.

4. Service Usage and Limitations

EyeOnKid provides monitoring services that may include tracking:

  • Location data, web browsing history, app usage, SMS, contacts, keystrokes, screenshots, and social media activity (depending on the device and platform).
  • iCloud backup data for iOS devices (with user-provided Apple ID credentials).

Limitations include:

  • Functionality may vary by platform (e.g., iOS has limited features due to Apple’s security restrictions).
  • Some features (e.g., SMS monitoring) are only available on Android with specific permissions.
  • The Service requires an active internet connection to sync data to your dashboard.
  • We do not guarantee uninterrupted access to the Service and may perform maintenance or updates that temporarily affect availability.

5. Payment and Subscription

EyeOnKid offers subscription plans (e.g., Basic, Premium, Enterprise) that determine the number of devices you can monitor and the features available. By subscribing, you agree to:

  • Pay the fees associated with your chosen plan, as outlined on our pricing page.
  • Provide accurate billing information and authorize recurring payments for your subscription.
  • Notify us of any changes to your billing information.

All payments are non-refundable unless otherwise stated in our refund policy. We reserve the right to change subscription fees with prior notice.

6. Termination and Refunds

We may terminate or suspend your account if you:

  • Violate these Terms or engage in illegal activities using the Service.
  • Fail to make payment for your subscription.
  • Use the Service in a way that harms EyeOnKid or other users.

You may terminate your account at any time by contacting support. Upon termination, you will lose access to the Service, and all data associated with your account may be deleted after 30 days. Refunds are not provided for unused subscription periods unless required by law.

7. Intellectual Property

All content, software, and materials provided as part of the Service (e.g., the EyeOnKid app, website, dashboard) are owned by EyeOnKid or its licensors and are protected by intellectual property laws. You are granted a limited, non-transferable license to use the Service for personal or business purposes as permitted by these Terms. You may not:

  • Modify, reverse-engineer, or distribute the Service.
  • Use EyeOnKid’s trademarks, logos, or branding without permission.

8. Liability and Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. EyeOnKid does not guarantee that the Service will be error-free, secure, or available at all times. We are not liable for:

  • Any indirect, incidental, or consequential damages arising from your use of the Service.
  • Any loss of data or privacy breaches resulting from your failure to secure your account or device.
  • Any legal consequences arising from your misuse of the Service (e.g., monitoring without consent).

Our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid for the Service in the preceding 12 months.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service will be resolved through binding arbitration in India, conducted in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. We will notify you of significant changes by posting the updated Terms on our website and updating the "Last Updated" date at the top of this page. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.
